Ethics Channel

What is it?

The Internal Reporting Channel or Whistleblowing Mechanism of Aranguren Comercial del Embalaje, S.L. (Aranco) is a secure and confidential means of reporting facts or behaviours that may constitute a legal, ethical, or regulatory breach within the company.
It enables any person in a work-related or professional context linked to Aranco (employees, former employees, suppliers, contractors, partners, interns, or candidates) to responsibly report potential irregularities.
The management of this channel is carried out externally, independently, and confidentially by the company GESPRODAT S.L., ensuring compliance with Law 2/2023 of 20 February, governing the protection of individuals who report regulatory infringements and the fight against corruption.
 

How does it work?

The channel provides a secure online form through which the reporting person can submit their communication, either anonymously or with identification.

Once the information has been submitted, the system will acknowledge receipt of the report within a maximum of seven calendar days.

The report will be reviewed and, if deemed appropriate, an internal investigation will be initiated under strict confidentiality.

The procedure will be resolved within a maximum period of three months, which may be extended by a further three months in justified cases.

Throughout the entire process, the reporting individual will be able to monitor the status of their report and provide additional information.

Guarantees for the Reporting Person

  • Full confidentiality of their identity, of the individuals concerned, and of the information provided.
  • Possibility to submit anonymous reports.
  • Protection and absence of reprisals for those who report in good faith.
  • Protection of personal data in accordance with Regulation (EU) 2016/679 (GDPR) and Organic Law 3/2018.
  • Right to receive information on the outcome of the report and the closure of the case file.

Responsible Use of the Channel
This Channel must be used solely for reporting matters related to potential legal or regulatory breaches. Commercial claims, employment queries, or issues unrelated to its purpose will not be handled through this channel.

The Internal Information Channel or Whistleblowing Channel will provide whistleblowers who access it with the information set out in Article 13 of Regulation (EU) 2016/679 (GDPR):

  • The identity and contact details of the controller and, where applicable, of its representative; namely Aranguren Comercial del Embalaje, S.L. (Aranco)
  • The purposes of the processing for which the personal data are intended and the legal basis for the processing. In this case, this will be the management of communications made by whistleblowers, compliance with legal obligations applicable to the data controller and, where applicable, the reporting of infringements committed to the competent authorities.
  • The recipients or categories of recipients of the personal data, where applicable; [Specify]
  • Where applicable, the controller’s intention to transfer personal data to a third country or international organisation and the existence or absence of an adequacy decision by the Commission, and the appropriate safeguards. [Specify]
  • The retention period. The general retention period shall be 3 months. However, the personal data processed shall be retained for the time strictly necessary to decide on the appropriateness of initiating an investigation into the reported facts; in any event, any personal data not necessary for the investigation shall be deleted immediately.
